Individuals can not apply for an H1B visa to allow them to work in the US. The employer must petition for entry of the employee. H1B visas are subject to annual numerical limits.

Visit USA Reply with quote
Shabnum you should marry somebody in USA. That would be the best bet and easiest way for you to relocate to USA. Otherwise there are many other options. Like Student visa, work visa, visitor visa etc etc. For student visa you have to get admission in USA and have lots of money to pay the tuition and other costs.

fFor work you have to have an H1B visa ...an employer needs to apply for you. Visit visa can be obtained by having a genuine reason to visit.

THE STATEMENT OF Vinode Khanna IN SUPPORT for immigration from India to USA
To Whom It May Concern:

I, Vinode Khanna, Make this Statement in support of my application for permission to apply for Visa of the Immigration authorities. I was born in India on 10th June 1973 to a conservative Hindo family. I was raised as a Hindo. I converted to Christianity. I would like to the Immigration authorities attention to the Hindo legal edict with regard to apostasy. The fact that under Hindo, any one committing apostasy, i.e. converting from Hindo to any other religion is regarded as an apostate and as such he/she is liable to a sentence of death. Additionally law of blasphemy is very much in the statute in India, whereby any local padri or indeed any body can evoke the Shari a (Hindo Law) and file a complaint against any member of the minority faith. I respectfully the authorities note that over last few years an number of Christians and members of other minority faiths have been prosecuted/persecuted and some have been sentenced to death, though no one has so far been judicially murdered. I have noted the Learned Immigration Authority’s comments regarding the present government’s attempts to stem the tide of Hindo militancy. However, I would like to draw attention to the fact that India is an Hindo Republic and as such all laws must comply with the Shari a. It should also be noted that it was in India that Taliban was born and it is India where most of the Al Qaeda/Taliban operatives are to be found. Hindo militancy is out of control in India; a number of Churches have been bombed, resulting in loss of lives of ordinary India as well as foreign Christians and Hindos cooperating with the so-called ”Infidels”. India and many other neighboring countries are bearing the brunt of these militants. I have been converted and went through full baptism. I knew that I would be at risk in India if I publicly announced my conversion. Even my parents disowned me because of my conversion. I was not able to practice my faith freely in India. It was only after I begun to receive death threats and I knew that stay in India, my life would almost certainly be in danger or at the very least I would face very inhuman and degrading treatment at the hands of population at large, with active cooperation and support of the judiciary and other enforcement bodies that I actively considered leaving India. My family had deserted me; I have no one in India to live here. It did not matter where I sought refuge; all I want to do go to a place, where I would be able to practice my faith without fear. I had recently escaped persecution. My neighbors with the active encouragements and some times participation of law enforcement authorities had persecuted me. I had developed and innate fear of people in the authority. I just wanted to disappear among the vast multitude and be left alone. I am in genuine fear of my life, liberty and persecution in India. I have number of documentary evidence including as number of country reports on India, which clearly shows that people converting from Hindo face certain persecution at the very least. In India, where I face certain death or at the very least torture. My human Rights would be violated if I live in India Human Right Acts 1998 articles 2,3,5,6,9,and 14.
Taking all these in to my consideration I humbly ask the Immigration Authorities grant me permission to apply for a visa in your country.

I look forward your response as soon as possible.

Yours truly,

Vinode Khanna

Hi,
I would suggest you to apply for visit visa first. Nowadays, it's not that hard to get US visit visa as it was few years ago. If you could not get the visit visa or you think that you have higer qualifications in "science and arts" then you have a lot of other option to visit and work in US through H-1B and H-2B visa. H-1B is temporary and will allow you to work in US as a full time employee but most likely for less than a year. But, it takes a lot for employer to comply with the requirements but response from USCIS is quick. However, on the other side, H-2B can let you stay and work in US for max 6 years and you have chances to get green card through such process, if your employer consider sponsoring you. Requirements for H-2B are high but easy to meet, if you fall under higly quailified category. If you have given the specific facts, I could have been more of help. Good luck.
