JUDGES ON TRIAL

Almost after every 11 years in Pakistan our armed forces violate the constitution and take over the reins of the country in their own hands, though it is welcomed everytime, thus creating a mayhem for the judiciary to validate it. The sorry affair is that once Justic Munir did it by creating a new theory, it is done every time. Even the present diehard CJ did not remain behind and swore allegiance to PCO of the Chief Executive who was so by his self proclamatioin.
Now the question that is to decide by the judiciary is not that the removal of the chief justice is valid or not. The question is, does the executive has the power to make the chief justice dysfunctional or to send him on forced leave or the segregate him from the world or to bar him from entering his office? It is very tough to decide and it is really a cumborsome job for the judges to decide it on merit when the chief of the army staff is also the president of the state that is another violation of the constitution. If the reference against the chief justice is invalidated, there is fear of another martial law or the cleansing of the judiciary through another PCO. Hence the discretion of the full court is being test. We can only pray that there must be something good for the country in store.
