| 1973 Constitution and lack of Accoutability…… |
|
Article 248 of the 1973 Constitution
“248. Protection to President, Governor, Minister, etc.
(1) The President, a Governor, the Prime Minister, a Federal Minister, a Minister of State, the Chief Minister and a Provincial Minister shall not he answerable to any court for the exercise of powers and performance of functions of their respective offices or for any act done or purported to be done in the exercise of those powers and performance of those functions:
Provided that nothing in this clause shall be construed as restricting the right of any person to bring appropriate proceedings against the Federation or a Province.
(2) No criminal proceedings whatsoever shall be instituted or continued against the President or a Governor in any court during his term of office.
(3) No process for the arrest or imprisonment of the President or a Governor shall issue from any court during his term of office.
(4) No civil proceedings in which relief is claimed against the President or a Governor shall be instituted during his term of office in respect of anything done by or not done by him in his personal capacity whether before or after he enters upon his office unless, at least sixty days before the proceedings are instituted, notice in writing has been delivered to him, or sent to him in the manner prescribed by law, stating the nature of the proceedings, the cause of action, the name, description and place of residence of the party by whom the proceedings are to be instituted and the relief which the party claims.”

With the above indemnity clauses, no wonder our lot loot the country OPENLY with out a fear in the world. We have seen the fate of Pakistan under Musharraf with such protection offered by the constitution. Can you imagine the looting spree about to take place if Zardari assumes the role of a Powerful President, his lips must be watering with the feast on offer – the Whole of PAKISTAN is on the menu.”
He & his Gang have 10 years looting to make up for plus commission. Nawaz must be worried there will be nothing left when his turn finally comes around!!!
Such a clause is Un-Islamic and only serves to add to Corruption as the fear of accountability is removed and the THIEF can hide behind the INDEMNITY offered by Article 248. So Asif Gardari and the 40 thieves look to be set now that the Genie (Musharraf) has left the stage.
Time for a change , I think so…..

Why we are always shouting for the change of our political system & structure.Mr.Z.A Bhutto wanted also utmost power,he was also self-centred person not to be accountable to any one (Human flaws).Although he was far better than all these Chors including Benazir.All these clauses of constitution leads Dictators to include the 58/2b in the constitution.i have to mention here one thing in our country due to thee lack of conditions necessary for the success of democracy,the so called democratic Govt;s proved to be the worst majorly because of the totalitarian & authoritarian mentality of their socalled political leaders.Mostly they are fuedal or businessmen (Although through corruption in the shadow of these both) they get spoiled when they gets power.We need indeed a personality which is a true Muslim not verbally but practically to rule this country must not be democratic in nature.

I agree we need correct personalities but surely that needs to go hand in hand with the correct govt. structure and system.
One without the other will not deliver desired result!

Implementation of Islamic Shariah but in its real spirit.Not by these "Dang Tapao" Mullahs rather by the real "Mufakireen e Islam".

Yes! Implementation of Shariah with understanding of the World reality and backed up with Islamic knowledge (Daleels).
Most of Mullahs just give lip service and have no knowledge themselves of the structure of the ISLAMIC ruling system.
However I have come across people who do back up their words with substance and Daleels. They have presented an alternative economic system, judicial, political, constitution etc.
